Anti-Fraud & WBS
BPR KAS Indonesia's fraud prevention strategy and official reporting channels, prepared in line with POJK No. 12 of 2024 on the Implementation of Anti-Fraud Strategies for Financial Services Institutions and POJK No. 18/POJK.07/2018 on Consumer Complaint Services in the Financial Services Sector.
Legal Basis
This page is public information prepared with reference to the following regulations:
POJK No. 12 of 2024 on the Implementation of Anti-Fraud Strategies for Financial Services Institutions
Applies to all financial services institutions, including People's Credit Banks (BPR). It establishes four anti-fraud pillars, requires a fraud detection system, and requires the anti-fraud strategy and its reports — including reports on significantly impactful fraud — to be submitted to the Financial Services Authority (OJK).
POJK No. 18/POJK.07/2018 on Consumer Complaint Services in the Financial Services Sector
Applies to People's Credit Banks. It governs complaint procedures, response deadlines and receipts, and requires the complaint procedure to be published on the bank's website.
The full texts of these regulations are available in OJK's legal database (jdih.ojk.go.id).
What is Fraud?
Under POJK No. 12 of 2024, Fraud is any deliberate act of deviation and/or disclosure intended to deceive, mislead, or manipulate a financial services institution, a consumer, or any other party, taking place within the institution and/or using the institution's facilities, resulting in loss for the institution, the consumer or another party, and/or giving the perpetrator a benefit, directly or indirectly.
Its scope covers the institution and the organisations it controls, consumers, and any other party working together with the institution.
Types of Fraud under POJK No. 12 of 2024
Corruption
Conflicts of interest harming the institution and/or consumers, bribery, unauthorised acceptance of anything of value, and/or extortion.
Misuse of Assets
Misuse of cash, misuse of inventory, and/or misuse of other assets.
Fraudulent Financial Statements
Overstating or understating net assets and/or net income.
Fraud or Deceit
Fraud or deceit in any form against the institution, a consumer, or any other party.
Leakage of Confidential Information
Disclosure of information the institution is required to keep confidential.
Other Comparable Acts
Any other act that may be treated as fraud under the applicable laws and regulations.
Four Pillars of the Anti-Fraud Strategy
The anti-fraud strategy comprises at least four interrelated pillars:
Prevention
Building anti-fraud awareness, identifying vulnerabilities, applying staff screening policies, and regularly communicating the anti-fraud programme to customers.
Detection
Complaint handling mechanisms (whistleblowing), surprise audits, supervisory controls, and a fraud detection system.
Investigation, Reporting and Sanctions
Investigating suspected fraud, reporting internally and to the Financial Services Authority, and applying sanctions in accordance with applicable rules.
Monitoring, Evaluation and Follow-up
Monitoring and evaluating the implementation of the anti-fraud strategy and following up on control improvements.
Implementation of the anti-fraud strategy is the responsibility of the Board of Directors and the Board of Commissioners, supported by a unit or function mandated to handle the implementation of the anti-fraud strategy.
Whistle Blowing System (WBS)
The WBS is a complaint handling mechanism that serves as one of the tools for detecting fraud. Customers, employees, business partners, and the public may report suspected fraud as described above through BPR KAS Indonesia's official channels.
